Terms of service
The essential conditions governing use of the platform. In plain language, like everything else.
1. Who provides the service
The platform is provided by Datashaker SA (IDI: CHE-189.174.010) , con sede in Viale Stefano Franscini 1, 6900 Lugano, Svizzera («Datashaker», «we»). By using the service you accept these terms.
2. Scope of the service
Datashaker automates the capture of accounting documents, the import of bank movements, reconciliation and posting into the client's accounting system. The service is an operational support tool: it does not constitute tax, accounting or legal advice, and does not replace your advisor. Responsibility for the final accuracy of the accounts and of statutory obligations remains with the client.
3. Account and access
Access is by personal credentials which you undertake to keep secure. You are responsible for activity carried out through your account. We may suspend access in the event of misuse or non-payment.
4. Pricing and invoicing
Prices are those published in the price list, in Swiss francs and excluding VAT. The subscription is monthly and renews automatically until cancelled. Usage above the included volume is charged at the published rate. Cancellation takes effect at the end of the current period.
5. Data and security
Your data is processed and stored in Switzerland. It remains yours: we do not use it to train third-party models and we do not sell it. On termination you can export it; we retain it for the period required by law and then delete it.
6. Liability
We provide the service with care but we do not warrant it will be uninterrupted or free of errors. Our liability is limited to the amounts paid in the twelve months preceding the event. We are not liable for indirect damage or loss of profit.
7. Changes
We may amend these terms, giving reasonable notice. Continuing to use the service after a change amounts to acceptance of it.
8. Governing law and jurisdiction
Swiss law applies. Place of jurisdiction: Lugano, Switzerland.
